Ballpark Murder Retrial Hearing Set, Gag Order Issued

Prosecutorial misconduct will be discussed on October 18th

Yesterday morning a judge declared a mistrial in the case of a murder outside of Citizens Bank Park in 2009. The mistrial came after a witness identified two of the accused assailants and testified that one had delivered the fatal kick to David Sale of Lansdale. Today, a judge set a hearing for October 18th to determine if that testimony was the result of prosecutorial misconduct. If so, all charges would be dismissed. Until then, a judge also imposed a gag order on all parties involved in an attempt to keep the press from being able to influence the hearing and possible retrial. [Inquirer]
