Montgomery Co. Officials Ask Judge to Toss Out Suit Over Same-Sex Marriages

Government reps say the Pennsylvania Department of Health does not have the standing to intervene.

A little lawsuit isn’t stopping a core group of Montgomery County officials from standing up for their district’s right to issue marriage licenses to gay couples. From the Daily Times: 

On Friday, county officials, in a response to the Pennsylvania Department of Health’s petition asking Commonwealth Court to direct Register of Wills D. Bruce Hanes to stop issuing the licenses, argued the state court does not have jurisdiction to review the matter and that the health department does not have standing to ask the state court to intervene.

County Solicitor Ray McGarry asked Commonwealth Court to dismiss the health department’s petition for review, which was filed on Tuesday.

According to the article, 49 gay couples have received marriage licenses in Montgomery County so far, and 12 of them have gone on to marry. Stay tuned for updates!
