Court Decision on MontCo Gay Marriages Could Take Weeks


The Times Herald reports:

It looks like it will be weeks before a decision is made in the state legal challenge to Montgomery County’s issuing of its own marriage licenses to same-sex couples.

In the Commonwealth of Pennsylvania, Dept. of Health v. D. Bruce Hanes, as Clerk of the Orphan’s Court of Montgomery County, the court granted part of the state’s application for expedited consideration.

Filed Tuesday, the court order essentially means that the state has until Aug. 12 to file a brief in support of “amended application of summary relief.” The county has until Aug. 19 to respond.

A judge will be assigned to the case when all the briefs are completed. No one has a timeline for how long the case might take after that.
